The punishment for sexual immorality in the Quran can be found in the following verses: 24:2-10, 4:15-16, and 4:25. Each of these verses deals with different categories of sexual misconduct and legal conditions.
Different Words for Sex in the Quran
In English, a variety of expressions are used to describe sexual relations, ranging from formal terms like sexual intercourse to colloquial phrases such as sleep together, make love, do the deed, or even do it. Each phrase carries its own nuance, yet all convey the same fundamental concept. Likewise, the Arabic Quran employs different words for sexual relations, carefully chosen based on context and purpose.
In English, adultery refers to sexual intercourse where at least one participant is married. In contrast, the term fornication refers to sexual intercourse between people not married to each other. However, you will see in many translations the term adultery is used loosely to signify sex outside of marriage for both forms of sexual immorality.
The term zina, throughout the Quran, appears to be the closest word to the typical English definition of adultery and is used throughout the Quran, arguably exclusively in the context where at least one of the participants is married. This word comes from the root “ zay-nun-ya” ( ز ن ي) and occurs nine times in five verses.
Most notably, this term is used in Sura 24:2-10 of which the context of these verses applies only in the strict definition of adultery when one of the participants is married.
Verse 24:2 informs us that for anyone who commits adultery ( zina), their punishment is a hundred lashes. This means at least one of the individuals is married and does not apply for fornication. This is because when a marriage is involved, the significance of such a transgression is much more severe than for non-married individuals.
24:2 The adulteress and the adulterer you shall whip each of them a hundred lashes. Do not be swayed by pity from carrying out GOD’s law, if you truly believe in GOD and the Last Day. And let a group of believers witness their penalty.
Verse 24:3 informs us that it is prohibited for a believer to marry one who committed adultery ( zina).
24:3 The adulterer will end up marrying an adulteress or an idol worshiper, and the adulteress will end up marrying an adulterer or an idol worshiper. This is prohibited for the believers.
Verses 24:4-5 discusses the punishment of one who accuses a married women of adultery ( zina) yet fails to produce four witnesses for their claim. Interestingly, the punishment is only mentioned if the accused is married and a woman. This shows that the Quran is giving extra protection to safeguard married women from such accusations.
24:4 Those who accuse married women of adultery, then fail to produce four witnesses, you shall whip them eighty lashes, and do not accept any testimony from them; they are wicked.
24:5 If they repent afterwards and reform, then GOD is Forgiver, Merciful.
Finally, verses 24:6-10 deals with infidelity within a marriage where one spouse may accuse the other of adultery ( zina), but without additional witnesses.
24:6 As for those who accuse their own spouses, without any other witnesses, then the testimony may be accepted if he swears by GOD four times that he is telling the truth.
24:7 The fifth oath shall be to incur GOD’s condemnation upon him, if he was lying.
24:8 She shall be considered innocent if she swears by GOD four times that he is a liar.
24:9 The fifth oath shall incur GOD’s wrath upon her if he was telling the truth.
24:10 This is GOD’s grace and mercy towards you. GOD is Redeemer, Most Wise.
As demonstrated above, all the verses in 24:2-10 deal with matters of adultery in its strict definition where at least one of the members in the act is married and does not specify a punishment for fornicators.
Another term that can apply to adultery or fornication is the term fahsha. The following verse informs us that contextually zina (adultery) is a category of fahsha (sexual immorality). Such that not all fahsha is zina, but all zina is fahsha.
17:32 You shall not commit adultery (zina); it is a gross sin (fahsha), and an evil behavior.
Sura 4 verse 15 discusses the punishment for women who commit fahsha (adultery).
4:15 Those who commit adultery (fahsha) among your women, you must have four witnesses against them, from among you. If they do bear witness, then you shall keep such women in their homes until they die, or until GOD creates an exit for them.
Here, the word adultery in the translation is used more loosely to constitute both pre-marital sex as well as sex where one of the participants is married. Therefore, if the fahsha also contains zina, then the punishment of 24:2 would also apply to the couple.
It is interesting that 4:15 uses the expression “ then seek witnesses against them, four, from among you” “ fa-is’tashhidū ʿalayhinna arbaʿatan minkum” ( فَٱسْتَشْهِدُوا۟ عَلَيْهِنَّ أَرْبَعَةً مِّنكُمْ).
We see this is different than the expression used in 24:4 and 24:13, which mentions the requirement of four witnesses, which states “with four witnesses” “ bi-arbaʿati shuhadāa” ( بِأَرْبَعَةِ شُهَدَآءَ).
24:4 Those who accuse married women of adultery, then fail to produce four witnesses, you shall whip them eighty lashes, and do not accept any testimony from them; they are wicked.
The reason for this subtly in the wording is clarified in the footnote of 4:15 by Dr. Rashad Khalifa. He states the following:
*4:15 A woman witnessed by four people in the act of committing adultery on four different occasions, with four different partners, represents a danger to public health. Such a woman is a depository of germs, and a health quarantine protects the society from her. A good example of an exit that saves a quarantined woman is marriage—someone may wish to marry her, and thus protect her and the society.
The term for adultery in 4:16 is “ yatiyānihā” ( يَأْتِيَـٰنِهَا) and simply translates to “they both commit it.” The “it” here is a call back to the fahsha mentioned in 4:15. Therefore, this verse informs us that there should be a punishment for any couple that commits fahsha. If the fahsha is adultery ( zina) then the punishment would be 100 lashes per 24:2. If, on the other hand, the fahsha was not adultery ( zina), then punishment must be doled out; however, in this case, repenting and reforming without fault is a possibility. We see in the footnote of 4:16 by Dr. Rashad Khalifa the following:
*4:16 Public exposure of the sinners is a major deterrent, as we see in 5:38 and 24:2.
This means that the community can decide what punishment to carry out. However, it cannot exceed the punishment for zina of 100 lashes. It is worth mentioning that this verb is also used for the people of Lot (7:81, 26:165, 27:55, and 29:29).
4:25: Half the Punishment for the Slave
Verse 4:25 informs us that if one marries a slave and commits adultery ( fahsha), then their punishment is half that of a free woman.
4:25 Those among you who cannot afford to marry free believing women, may marry believing slave women. GOD knows best about your belief, and you are equal to one another, as far as belief is concerned. You shall obtain permission from their guardians before you marry them, and pay them their due dowry equitably. They shall maintain moral behavior, by not committing adultery, or having secret lovers. Once they are freed through marriage, if they commit adultery, their punishment shall be half of that for the free women.* Marrying a slave shall be a last resort for those unable to wait. To be patient is better for you. GOD is Forgiver, Most Merciful.
Here, the term translated as adultery in this verse is fahsha. Since the context is a married woman having sex with someone other than her spouse, then this aligns with the typical definition of adultery ( zina). Therefore, the punishment for such a woman would be fifty lashes, per 24:2. Additionally, we see the following footnote from Dr. Rashad Khalifa regarding this verse.
*4:25 This law proves that the punishment for adultery could not possibly be stoning to death as stated in the laws of corrupted Muslims (see 24:2).
Final Thoughts
The Quran informs us that if God willed, He could have made the Quran volumes and volumes long and covered every conceivable scenario under the sun.
31:27 If all the trees on earth were made into pens, and the ocean supplied the ink, augmented by seven more oceans, the words of GOD would not run out. GOD is Almighty, Most Wise.
18:109 Say, “If the ocean were ink for the words of my Lord, the ocean would run out, before the words of my Lord run out, even if we double the ink supply.”
The Quran also informs us that the Quran is complete, fully detailed, and has explanations for everything. This indicates we have all the guidance we need for our moral decision-making.
16:89 The day will come when we will raise from every community a witness from among them, and bring you as the witness of these people. We have revealed to you this book to provide explanations for everything, and guidance, and mercy, and good news for the submitters.
A common mistake people make is expecting explicit rulings for every conceivable situation, leaving no room for reasoning or judgment. However, this is not how God’s system works. Instead of detailing every possible scenario, God establishes clear guidelines and limits while entrusting us with the responsibility of applying them wisely. These limits set the thresholds of floors and ceilings to what is permissible.
In the case of adultery and other moral issues, the Quran defines the boundaries of punishment but does not prescribe rulings for every specific condition one might encounter. This requires believers to apply Quranic principles, engage in thoughtful consultation, and make decisions within the framework God has set.
Those who abandon this responsibility by seeking secondary sources and treating them as divine revelation fail to uphold the Quranic method. When faced with issues not explicitly addressed in the Quran, the solution is clear:
Refer to the Quran’s guidelines.
Consult with fellow believers.
Make a decision based on reason and faith.
Trust in God.
This is precisely what the prophet himself was commissioned to do.
3:159 It was mercy from GOD that you became compassionate towards them. Had you been harsh and mean-hearted, they would have abandoned you. Therefore, you shall pardon them and ask forgiveness for them, and consult them. Once you make a decision, carry out your plan, and trust in GOD. GOD loves those who trust in Him.
This is the true test of faith: whether we trust in God’s system and adhere to His protocols and procedures or disbelieve and pursue other sources of law, which God has placed no authority and explicitly told us to not to take from.
45:6 These are GOD’s revelations that we recite to you truthfully. In which Hadith other than GOD and His revelations do they believe?
45:7 Woe to every fabricator, guilty.
45:8 The one who hears GOD’s revelations recited to him, then insists arrogantly on his way, as if he never heard them. Promise him a painful retribution.
4:59 O you who believe, you shall obey GOD, and you shall obey the messenger, and those in charge among you. If you dispute in any matter, you shall refer it to GOD and the messenger, if you do believe in GOD and the Last Day. This is better for you, and provides you with the best solution.
4:60 Have you noted those who claim that they believe in what was revealed to you, and in what was revealed before you, then uphold the unjust laws of their idols? They were commanded to reject such laws. Indeed, it is the devil’s wish to lead them far astray.
6:112 We have permitted the enemies of every prophet—human and jinn devils—to inspire in each other fancy words, in order to deceive. Had your Lord willed, they would not have done it. You shall disregard them and their fabrications.
6:113 This is to let the minds of those who do not believe in the Hereafter listen to such fabrications, and accept them, and thus expose their real convictions.
6:114 Shall I seek other than GOD as a source of law, when He has revealed to you this book fully detailed? Those who received the scripture recognize that it has been revealed from your Lord, truthfully. You shall not harbor any doubt.
6:115 The word of your Lord is complete, in truth and justice. Nothing shall abrogate His words. He is the Hearer, the Omniscient.
6:116 If you obey the majority of people on earth, they will divert you from the path of GOD. They follow only conjecture; they only guess.
